Evaluating an investment migration programme

Questions about eligibility, source of funds, programme rules, adviser responsibilities and financial commitments before pursuing investment migration.

An investment migration proposal should withstand the same scrutiny as any other significant legal and financial commitment. A polished presentation should be supported by clear answers about the programme and your commitments.

Establish the legal basis

Ask for the current official rules, responsible authority and the precise status being offered. Distinguish an announcement from an operating application route, and residence from citizenship. Have a qualified local lawyer confirm how the rules apply to you and your family at the time you intend to apply.

Expect meaningful due diligence

The FATF and OECD identify money-laundering and integrity risks in investment migration programmes and emphasise due diligence and transparency. Read the joint report overview.

For your own preparation, ask which records are needed to explain ownership, source of wealth and the funds proposed for the transaction. Agree a secure document-transfer process with your advisers. Do not send sensitive documents through an initial enquiry form.

Understand what happens to your money

Before paying, request a breakdown of professional fees, official charges and investment commitments. Establish the payment recipient, refund conditions, holding periods and what happens if an application is refused or delayed. Ask an independent adviser to assess the commercial risk of any underlying asset.

Know who is responsible

Your engagement should identify who provides legal advice, who submits the application, who handles funds and who communicates with you. No adviser can replace an authority's decision with a guarantee. Make sure the plan also covers your existing tax and reporting obligations.
